I am married and enlisting in the Army. I lost my job and had a surgery in Jan. of this year, my husband also has debt and pays child-support which is current, but we have had a car repo and I, have medical bills, no credit card debt, but have misc. bills and NEED relief–is it in my best interest to try and file bankruptcy before I go "Active" or after I enlist? OR can my husband place the bankruptcy in his name and we handle the "joint petition" that way in case I can’t be available for court? Also, is it true that JAG can’t file the "joint petition"–and if not, if I decide to file once in the Army, do I just follow the protocol of a civilian, and if so, where do I go in the military to disclose that I’ve had to file–my commanding officer? I understand I will not receive a security clearance just due to bills being past due–but should we begin the process now or once I finish AIT?

You need to talk to a bankruptcy lawyer now to get true scoop. The military legal system can’t help you file for bankruptcy. Additionally, bankruptcy filings must be in the state of residence.
You also need to talk to your recruiter about the situation.
