There was a note left on my office door that a process server is trying to serve me with legal documents. I’m pretty sure it’s regarding Capital One credit card that I have not paid. Has anyone had this happen to them ? I don’t need any of the "pay your bills" comments, so please dont respond if that’s all you have to say. I just want to know what the best thing to do from here is. I had a part time job, fell behind on all my credit cards, but this is the first from a process server. I have two jobs now, and I’d like to start paying what I owe, but these credit cards that offer to "settle" for less, often ask for the whole amont. Example, on one card, I owe 00, but they are willing to settle for 00. Well I don’t have 00 laying around. Please help with any advice on this type of situation.

Thanks Bryan. I’m not entirely sure it’s Capital One that served me, because I haven’t called the process srvr back for them to deliver the papers. I had another credit card that was around the same balance as capital one (00) that offered me the 00 settlement. Capital One never offered me that low of an amount. I am willing to pay that 00 to the other credit card, but it’s not like I have it laying around. Family members not an option unfortunately.
As far as Capital One, it was opened in California, I stopped paying roughly about a year and a half ago, and I now live in Nevada.

I am a process server and you may be getting worked up for nothing. Like you said you don’t even know if papers are from Chase. Call server back and get the paperwork so you know what your looking at. The process server only has to make 3 attempts to deliver than xan get an order from judge for sub-service. Witch means he will tape it to your front door for everybody to see.
Capitol one has a aggressive collections department I am afraid. How old is this debt? It looks like it may be fairly old if they are willing to settle 1200 for 4500. If this is a old debt it could be past the Statue of Limitations meaning you can use this as a affirmative defense then they would loose the case. If this is not the case I would find somehow to take that settlement, borrow money from a friend, family member. The thing is a 4500 balance could end up a 9,000 judgement against you. If you do make a settlement they must agree in writing that it will be satisfied and send the payment via money order. If you want a solid answer please tell us when was the last payment made on your capital one, your state when you opened the account, the state you currently live in. Also if it is capitol one that is offering you that settlement or is it another agency. There are plenty of folk that answer questions in here that help consumers understand there rights.
I have to wonder if the one offering a $1200 settlement legally owns the debt or can legally collect.
